No one in his/her right mind can argue that the death of this kid hasn't been caused without malice and a distinct lack of concern for the victim's life. It was being downright tortured for days. That is straight up second degree murder by all possible interpretations of the definition.
I hope the get sentenced guilty of murder. By all accounts of what I just read the legal definitions are crystal clear.
As for the capital punishment discussion, that crap doesn't work past the obvious revenge angle. Even death penalty doesn't deter people from committing crimes, in fact it makes it easier to pass the moral horizon once people feel like they've the point of no return and will subsequently escalate their willingness to commit crimes just for the chance to get away. If someone just murdered a guy and would get the death penalty once caught, what's to stop him from just murdering everyone else who gets in the way as he's trying to run for it?
No, punishment only works after the fact. If you want less crime, the system has to grip all the way at the start, in school and with parenting. With emphasis on the school, because good parents don't simply fall from the sky, but even a child with less than perfect parents can be aware of their shortcomings if education supplements the ideals. You can't punish people into becoming better, you have to grow them into it.
For people like this, parents on their own that for some inexplicable reason (at least without any more context than I just read) start beating a friend's children to death, all hope is lost and I feel sorry for their children aswell who no doubt must've had similar experiences on their own (stuff like this doesn't tend to be one-off events, people don't snap randomly and when they do they snap at their percieved wrongdoers, a criteria those children would hardly meet). As tragic as it is for the dead kid, his sister and family, the four children from the murder pair quite probably suffered similarily and are by all means, SHOULD by all means no longer be under the care of those two.
